Your profile is a bit confusing. But the jist of it is, was Dad in his right mind to assign a POA and why an estranged niece? I think you need to call a lawyer or your State Ombudsman. The hospital should show you proof that Dad assigned a POA. The paperwork should have his signature and signed by a notary.

Did your dad assign the POA? If not, it's not valid, nobody can assign a POA but the principal.

Unfortunately, his wife is legal next of kin. She has all the power.

Just curious, if this male beat your mom to death, why would you want to be there for him now? Maybe, this is his consequence for his actions, dying alone.
