I had to put mom in nursing home. I was (and still am) living in her home. Now that the caregiver is in charge, how long may I still live in her home?

Brother was put on as POA after me and all went downhill.

I was POA and caregiver for mother. I was living with her in her home. I was taken off as POA and replaced by my brother in secret. Now that she has a guardian, do I have any say in the home and posessions? Could I have yard sales? I am still living and caring for home. She has dementia. I was POA and caregiver 3 yrs.

The guardian is in charge. They will determine if the house needs to be sold or what happens to her belongings.

Please try to give us more information. Who will be paying the mortgage (if any), taxes, utilities, insurance and upkeep on the home? What is your brother telling you?

If she has a guardian, this means the courts are now involved, that is the only place you will be getting answers.

The court that assigned a guardian is where you need to ask these questions.

This is a duplicate. Other post was in discussions. Seems there is a guardian.

If there is a guardian, brothers POA is revoked. You need to talk to the guardian. Make it clear that you were Moms Caregiver for 3 years and her POA. If Mom is now on Medicaid, the house is an exempt asset while she is living. You could claim Caregiver rights to remain in the home because u resided there. Call Medicaid and confirm what I have said.

If Mom was not competent to assign brother POA, it really is no good. But if a guardian is now involved, both POAs are revolked.

That's up to the POA. Their job is to look out for your mom's finances, so at the very least you should be paying rent at the market rate. However, if her house needs to be sold in order to pay Mom's nursing home bills, then out you go.

I don't completely understand -- is your brother POA or you?
