My mom has been in NH 3 months and they had a court hearing for guardian. They sent a letter to my old address but now there is a plenary guardian. How can I bring her home?

How can I bring her home without kidnapping her? There is a plenary guardianship. What can I do about this? The nursing home said that they sent me a letter that was for an old address, and when I visited her often I made sure I gave them my current information.

NHs often seek guardianship when one of their residents is incapacitated and unable to see to their financial affairs. Was there a POA who was taking care of the bills and other matters? If your mother was incompetent, they may have felt they were acting in her best interest. The probate court apparently agreed if they granted guardianship. This is not a bad thing if your mother is going to be staying there.
