He had to present a POA to the AL. They would want it on file. I have mine for Mom on file at our local hospital and with Drs. Just because he is her husband Drs. don't have to talk to him.

Can you just ask to see the POA? Why would he not be truthful? Are you concerned he’s mismanaging Mom’s finances? When I was my mom’s POA, I had to account for all her money and even show receipts to the facility where she was.

If you are not privy to Mom’s papers, it would be rather difficult to find out if he does have POA. I got mine through Legal Zoom so I had the documents at my home, but if your stepfather used a local attorney and you can find out who it was, they should have records. I don’t think those documents would be sealed.

He is by law her next of kin, so that may be his trump card.

As long as you are married and she has not said anything against him, medical personnel will honor that he is the legal next of kin and that is a hard one to get around.

My dads ex wife got away with untold horrors because they were legally married.
