How do I get my mom into an inpatient rehab if she transitioned home but still needs assistance?

My mom had spinal surgery in July 2020. She went to a facility that was supposed to help with rehab but had her in the bed for 4-6 weeks drugged up. I eventually had to remove her and bring her home only to find out she ended up with a DVT. I had to put her back in hospital for which they put a stint in and placed her in another facility. This facility in turn was to do rehab, let her back get infected and a the surgeon had to repeat surgery to clean the infection. Then she ended up in another facility that was suppose to be a rehab facility, only not well equipped for rehabilitation but a nursing home facility. Now she came home, had PT and OT which she did well but the therapist seems to believe she needs inpatient because she needs two people assistance to be able to walk. I am getting so frustrated with this because it seems no one really cares about her after therapy and not getting her in for additional inpatient therapy. I may have to get lawyers involved because I feel she is getting neglect because of her age. The doctor told her if she did not have the surgery, she would never walk again. Now she has had the surgery, they should be responsible for her getting well.

Pthomas you haven't filled out your profile, so I cannot tell how old your Mom is. She has suffered a lot of complications. Your current in home Physical Therapist has made a recommendation to you that he or she should now carry forward to the ordering MD, the recommendation that in-faciliity care is required.
I do not know what has been charged now to the medicare limits of rehab payments, and there are also some restrictions I am no expert on as to how often in a year, or how many months time (I think 60 days) between rehab facilities would be covered. You definitely do not want to slip into self pay which is very expensive indeed.
I also can have no idea of what the notes from prior rehab show about your Mom's ability to participate and to progress.
Clearly you are POA. I would start with therapist recommend and the doctor ordering the in home PT. That it isn't working and rehab in facility is needed for the reasons you state. I don't know that a lawyer could help you much with this, but I understand it being a last resort you may have to try.
