My step-sister and I are on our parents bank account. When they die can we just keep the money or would it have to go to probate?

And have it distributed by their will. There is an evil sister in the picture that we want to cut out but she is in the will....

The accountownership must read that your mother and the two of you hold the account as "joints tenants with rights of survivorship" in order for the two of you to inherit the funds.
