I was recently falsely accused of elder abuse to my Mother by her neighbor and former friend to DCF. Do I have any recourse?

4/3/2017 I had to call 911 to have rescue come to my Mother and my home as she had a 102.8 fever; she has degenerative scoliosis & arthritis in her whole spine & at the time was on 2 different narcotics (which were incorrectly given to her by an unnamed clinic here in Jax, FL), she is 75 years old; therefore, I felt it NECESSARY to call for help. Good thing I did (per the ER doctor who admitted her) as she had a slight case of "Double Pneumonia" which in less than 24 hours turned into Full Blown Double Pneumonia and was incubated for 6 days not to mention, I almost lost her. But, by the Grace of God I didn't! On or about 5/3/2017 Mom informed me that a DCF representative had come to see her in the assisted living home/rehabilitation facility. I was shocked and asked why? She told me that "someone" had reported ME to DCF because I abused her. Both of us were extremely upset over this FALSE ALLEGATION and pretty much narrowed down the accuser. DCF has been a pleasure to work with and since I used to own a mobile home park and was quite fluent with DCF and on VERY GOOD TERMS with many of them, I was found NOT GUILTY of abusing my Mother. Not only did she tell the DCF worker that the allegation was VERY UNTRUE, my Mother and I are and have always been BEST FRIENDS! What I want to know is, because this allegation was falsely and maliciously made and is a definite DEFAMATION OF CHARACTURE, do I have any recourse against this person, legally speaking?

Actually the DCF Worker kinda let the car out of the bag & more or less confirmed that it was in fact who we thought it was. She's supposed to get back with us this week. I so know since I'm innocent she basically has to provide all info together the D.A. & hopefully they will prosecute as it is a felony. Karma is a B****.

So sorry you r having these problems. Just taking care of Mom is hard enough with this. Maybe u should get some camera's and u can catch the person in the act. She probably thought she had a good thing going before u came. Hope u reported the pump just to have a record. Put the cameras up when the suspectvis not home so she is not aware of them.

Since you will never get them to tell you who made the report...you will never have proof that the neighbor did it. Further...this goes to intent....very hard to prove the intentions of someone making a report. You can suspect, and maybe even "know" in your heart...but the rules for evidence probably cannot be met.

Ya know, I wish I could...however, due to former actions of this person (prior to me moving in with her) stealing her house keys (yes, we told the DCF worker) on 3 separate occasions, causing me to have to change the locks ($$$$) to ensure her security & actually just yesterday, when she's just been home 3 days now, we discovered that her well pump was turned on with no water to it & it's burned up, it's kinda like....Dude, quit! Enough is enough & Me being the person I am...IT'S ALL ABOUT PRINCIPLES. Agree?

Happened to me too. No there is no recourse. Attorneys will only accept defamation on large, important, rich people or firms.

I don't believe you have any recourse here. People can make reports to adult and child protection agencies and remain anonymous. It is necessary, because people would be afraid to report what they see if they thought there could be repercussions. If the agency learned the charges were unfounded, then it didn't really defame your character. I understand how you feel. I would be p*ssed, too. But I would just let it go.
