What is procedure when a nursing home fails to provide medical records?

You hire an attorney. The documents are submitted to the judge in court. That way the judge knows there are no errors, omissions or alterations by you.

More information is needed.

1. Did you request the records, assuming you're the proxy and your mother executed the healthcare POA?

2. How did you request them? Verbally? In writing? Did you do it as a proxy or did your mother execute the request and release?

3. How much time has elapsed? Did you ask for the record urgently?

4. Have you received any response? Did the nursing home ask for a fee first? (Copying records is expensive.)
