My Dad has Parkinson's with dementia. He fell twice last week letting the dog out and broke his hip. How do I take his dog away from him?

He doesn't remember to take her outside, so she messes in his ALF apartment. Now that he has fallen and broke his hip, he is now at a nursing home for rehab. The dog is being boarded at the vet. I cannot take her as our dogs don't get along with her. She is 8 years old, needs meds and special food.
