How do I get guardianship of my Mother?

My mother is in a dementia unit in Santa Fe, NM. Her husband is now in the Assisted Living section of the same Home. I have been told by the staff there that he is developing Alzheimer's as well. We have had issues with him about the financial aspect of her care - He has control (not a problem). I have Medical Power of Attorney for her. I would like to come to some agreement with him on her remaining time and care (Hospice is now being provided for her). Can I get guardianship so that i may make decisions that will need to be made in case she passes. I would like to pay for any costs associate with funeral, etc. and be able to bring her home. I live in Connecticut.

He doesn't have Durable Power of Attorney - I do (Medical). I never thought to take away his right to finances as he is her husband but I had to bring her home to CT and needed to be able to make decisions when she got sick (her blood sugar count was at 890) when she was living with him. We were able to control it and get her on a strict regimen and she went back to NM to be with him (quantity or quality of life was what I was told. 1 year later we had to place her in the Home (at my suggestion since he wasn't able to take care of her - she needed too much and the dementia just wasn't manageable at home). To answer the question: where does she want to be buried? I'm going to assume here. She never wanted to be buried next to his late wife.

See an elder law attorney. If your dad fights it and he has her Durable Power of Attorney, I doubt it will happen.

Where does your mom want to be buried? Wouldn't her husband want her wishes honored?
