How does a life estate affect Medicaid benefits for a nursing home?

I inherited a life estate from my Mom in her residential home when she died. How will this life estate affect my eligibility for Medicaid.

When it comes to Medicaid, please see an Elder Law attorney as this can be complex. The issues come to play if you need to move out and into assisted living or a nursing home... in a "life estate" you become a "life tenant", thus you are responsible for the house as long as you are alive.

I don't believe Medicaid can make any claims on the house, but if you rent out the house [you wouldn't want to leave it vacant] Medicaid could claim the rent. Even though your son inherited the house, you are still the "life tenant". You son could move into the house, but Medicaid might question if he is paying you rent or not. See how it can be complicated. An Elder Law attorney could work through this maze.

Steveys, need some clarification, please.... who inherited the house, was it you or another family member or a charity who needs to let you live in the home for the rest of your natural life?
