Read IRS publication 502. I'm researching the same thing myself right now and the publication spells it all out in detail.

Cound't the family pay you as a gift, which (up to a certain amount) is not taxable by the IRS, check with your tax person.

I agree there should have been an agreement plus the wages would be taxable. I assume he paid for his needs so he can't be claimed as a dependent. My sister tried to get away with this and got into trouble! She was charging my father $875.00 a month to stay with her without anyone knowing it until he died and I became executrix.

I'm 24/7 here too. I file as head of household.

I agree an arrangement should have been in affect of the caring and getting paid.. and get a 1099 and have a seperate EIN # for taxes i do private care and keep records of payments i am sorry i do not know about after the fact you could however sit down figure out a rate of payment and receive it and go from there

For tax purposes you can do as I did and hire an attorney to draw up a personal care contract that outlines your duties and payment. An accountant will need to issue a 1099 to you for tax purposes and yes you will pay taxes on that money and the attorney will cost you as well as the accountant who does his work for you.
Perhaps avoiding taxes by working it out with the family is your better option but they may want to write off the payment to you with the 1099.

You would have to work this out with his family.
