This exact scenario happened to my surrogate mother and father. I filed for guardianship (or tried to), but there was a niece involved in another state, and I told her what was happening. Then an attorney for both of them finally looked into matters. You do not say if this 85 yr. old has children, relatives and has dementia. Besides a good attorney, I would contact adult protective services as well. Tell them what you have told us, they will investigate and will report to the Court. Do not try and confront these people. I do not want to see you get hurt. The types of people who would take advantage of an elderly or anyone for that matter needs to be stopped - legally. Do it ASAP. Let us know what happens. It goes back to being an issue that should be handled by the Federal Senator of your state to get the right people involved.

This sounds definitely a clear case of financial elder abuse. If they take all his money what will this man have left? On top of that is he getting the care he really needs? I am a strong believer in mandatory reporting for all types of Elder Abuse and this case is why. If the VA does not investigate then what other options is there?

It sounds like you need to contact an Attorney that specializes in Elder Abuse.

Yes they have a POA, they are stealing money saying he needs these things. He is 85 and purchased an inground pool for him. He can't swim. He has no drivers license but has purchased a Suburban. They have moved their families in with him and made him build rooms for them.

Usually the Veteran or Surviving Spouse is reporting on what the care-giver is providing. The more the care-giver provides the more the Veteran or Surviving Spouse receives and the money should go directly to the Claimant not the care-giver.
