I've been in this field for 20 plus years. I started off in homes working for agencies. Never had a problem until I started at this Rehabilitation Center. I have been working my butt off and enjoy the work. Recently, I've been picked on by other staff members and when a resident fell, the other staff and the union tried to cover it up and put the blame on me. I wasn’t even working that day. The resident was upset, said she was leaving the facility and was planning to to sue the company. She had the names of the nurses and the CNA who were on duty.  She knew what she was talking about. This happened on a Sunday, I came in 3rd shift Sunday night. All was good on my end, the residents told me what happened. The nurse talked to the patient's family and told them what happened as well. They are covering for the CNA that was working the hall when she fell and trying to get me in trouble. I talked to another union rep and I am attempting to get in touch with the resident herself. I know for a fact who she has a problem with. I am really trying to  figure this out so my license is not taken away. All the residents loved me and it made me feel important. I need help!

Since the resident fell on the shift you weren't working that is the proof you need. Give your Board of Nursing a call. Tell them what you told us. You can send an email. Someone should contact you. You should have a schedule in your phone that you can refer to. Screen shot it and save it for proof later. Send a copy to your laptop and print it. This is your documentation. If the staff tampered with the schedule, this is fraud on their part. You can file a legal complaint with the Department of Labor and the Office of the Inspector General in your city and state explaining what has happened. Get someone to write your emails so they will be clear and concise.

Anything can come out of a resident's mouth, and it is not gospel. Yes, nursing personnel will tell lies on you to save their own skin. That is why I refuse to work in rehabs and LTC facilities. I worked for one agency where these clients would switch aides like underwear. You couldn't depend on the income because I spent more time with trying to secure a case. It wasn't worth my time.

Also, file for unemployment. Let unemployment know the you were fired unjustly because of another CNA. You weren't even scheduled on the shift when the incident happened.

If she fell on a certain shift, it should be recorded by the CNA if not the Nurse on duty. By law, her contact has to be notified. If you were not working that shift, thats on record too. People fall, it happens. See if you can find out thru the office where the resident transferred to. If your Union is not helping you, then go to the Labor Board. In my State the Nursing Board gives you certification. Maybe you can talk to them.

You can work privately with no certification. I know people who do it.

If your license becomes threatened you will need an attorney to represent you. You have a difficulty in responding yourself as your skills with writing about the situation are not great; you need help with responding to any legal action. For now you aren't indicating that you license is being threatened directly? You have been fired. Please have a friend who is good at writing a simple response that you were not even working on the day in question, and your work records will prove that, hence could not conceivably be help responsible for any mishaps on that particular day.
Keep this letter of response with you so you can give it to anyone who needs any proof you are innocent of the action.

I cannot see what else you can do, to be honest, and worry that you won't be up to advocating for yourself without the help of a friend who can help you organize and write out your responses and be at your side to help you gather thoughts and responses in any upcoming meetings.
