We just started home help care and the contract said we would be charged $30,000 if we were to hire one of the caregivers.

We thought about this years ago when we wanted to hire Dads companion, it would have cost us thousands to do it. Then the liability, workers comp,, you name it. And she could no longer work for the agency.

None compete clause is what it is called. And your agency probably has it. For your client to do what they want to do is stealing you away from your employer. And I will bet the contract your client signed says if they do this the agency can sue.

You would have to quit your job to work for these people. No way is an agency going to keep you on and allow you to work privately for a former client. In essence, u stole their client.

Redblue099, you need to read your employment contract with the Agency, too. There could be a clause where you cannot work privately with a current client until 6 months or a year later. Some contracts have a buy-out clause where the client would need to pay the Agency you work for to release you.

Did you sign a contract with the agency? If so, does it say anything about hiring the caregiver privately?
