My brother was in a long-term nursing home on Medi-Cal. He passed away on 5/1/25. Am I entitled to his nursing facility balance to cover funeral costs?

The nursing home said that he had a credit on his account and he doesn't owe them. They have sent a request to have the money in his account sent to me. They said I was the contact person for him. I never signed any agreement with them. I told them I would be the contact person if he was not able to talk or make decisions for himself. The money in his account would cover the cost of his funeral. He was on Medi-Cal with share of cost. He was collecting Social Security. We can't afford to pay for his funeral.

I would do nothing without talking to a Medicaid caseworker.

Is this the assets that were allowed and his Personal Needs Acct? In my State, this money goes to his estate. Medicaid is not entitled to it.

They have sent a request to have the money in his account [sent] to me. Who did the facility send this request to? Medi-Cal? The facility is probably contacting you because you are his next of kin. I'm in MN and my MIL was on Medicaid in LTC for 7 years then passed Dec 2024. We did not touch the money in her checking account because of MERP (Medicaid Estate Recovery Program). They took out every last penny. If Medi-Cal is like Medicaid in other states, I would contact them to see if you can actually even receive that money and use it to pay for his burial or cremation and if so, what is the process to have this happen. I'm sorry for you loss. May you receive peace in your heart as you bury your brother.
