If the independent living place requests that your 88 year old father moves out, basically kicking your father out within 30 days.

We found a place for dad and can move him before 30 days but the independent living is requiring that we pay for 30 days of rent even though we can move him out before that time. In other words, they are kicking him out so we found a place and can move him in 10 days but the independent living place wants their money for the full 30 days. We can't pay rent at 2 places. Is this legal to charge for 30 days of rent by the independent living company when they are kicking our father out?

Check the contract you have.
It might be different if YOU chose to move him out VS THEY ask him to leave.
Are they asking him to leave INDEPENDENT LIVING because he needs more help and his care if past what is safe in Independent Living? Does he need Assisted Living or possibly even Memory Care?
If you find that you do have to pay for the full 30 days then take your time moving his items out. Have a few meals there since you are paying for them.

I am afraid that's usually the standard, but there should be a contract that was signed on admission to this facility that explained the rules. Most IL, MC, ALF have their own rules; they are often self-pay, for profit, corporate entities run by contract. The norm would be a full month is paid. In some excellent places, after you move out leaving a place in excellent condition, there is some amount sent, but that is usually in ALF, not in IL. IL usually is rented by the month, and with a full month deposit.

Wishing you the best of luck. I, like others, worry (given the "kicked out") whether this is a correct level-of-care placement? I hope all goes well at the new place.

Consider yourself lucky. I had to pay 60 days rent for my parents upon move out from Independent Senior Living into Assisted Living, under emergency circumstances! Yes, it's legal and common practice in the industry. There are no scruples in society anymore, especially in business.

Yes, that is standard. I know it's frustrating. But it's good that you found a place that will take him so quickly. Sometimes if a resident is asked to leave one place, it's difficult to find a new one.

Read the contract .
It is not uncommon for this 30 days to be stated regardless of why or when he leaves .
