My aunt is mom's POA and didn't allow me to visit my dying mother. Can I sue for emotional distress?

BurntCaregiver Nov 2024
Have some dignity. No, you're not getting a payday because your aunt isn't nice to you.

Why is your aunt POA for your mother and not you?

No, that isn’t really something you can sue for. Plus, lawsuits are very expensive… like do you have $2500 to $5000 to give the lawyer a retainer right at the start?

No.

If you become adversarial with your Aunt she will definitely never let you see your Mom. You may want to consider seeking a family mediator through the court to enable a discussion between the 2 of you to come to a visitation agreement. But there are 2 sides to every story. What reason would your Aunt give as to why she is not allowing you to visit?

I think mom already died?
