Irrevocable trust signed close to death. Is it legal?

notgoodenough Jul 2024
Annie, if the person whose trust it was died, then a revocable trust changes to an irrevocable trust. Could this possibly be what happened?

Annie - you can probably google this question and get the answer - if you're asking others for advice on this site, you'd really need to elaborate more information on the situation.

From my knowledge, an irrevocable trust is usually done as part of medicaid planning - which has a 5 year look-back. Why would it be done close to someone's death? Or, if the intention is just to avoid probate, a revocable trust can be an option.

A lawyer would determine first if the person is of sound mind - and advise if an irrevocable trust is the best recourse for the specific situation and goal in mind.

It would help for you to explain more ~

If thevperson was in their right mind. If Dementia involved or on Morphine, I would question it.
