Is Social Security allowed to take Mom's last Social Security check?

My mom died 2/24/2019. Her Social Security check was deposited into her checking on 3/1/2019. With that I paid a lot of her bills. The social security put a hold of her remaining amount of 585.00 which brought her account down to a 0 balance. Are they allowed to take her last check?

Yes they are. If your mom would have made to the first you could gave kept it. They took my husband he lived until January 31st. Took it right out of the checking account. So sorry about your mom.

So Sorry for the loss of your Mom.

From the SS website:
“If a beneficiary dies
Let us know if a person receiving Social Security benefits dies. We can’t pay benefits for the month of death. That means if the person died in July, the check received in August (which is payment for July) must be returned.
If the payment is by direct deposit, notify the financial institution as soon as possible so it can return any payments received after death.”

I’m very sorry for your loss. Yes social security can and will take back the last check. Since it was issued March 1 and she passed in February, Social Security takes back the March payment. You will have to return the money you spent if her check was more than $585

They did this with my dad's,, he died on the last of Feb. Luckily I knew to expect it to disappear, and it sure did!

Please accept my condolences Pamelabranch.

My understanding is the same TNtechie. I remember from when my dad passed away. Social Security benefits end the day a person dies.

Thats a shame. Sorry for your loss.

Yes, as I understand it the 3/1 check would have been SS payment through 2/29 and since she didn't live the entire month she isn't entitled to a full month's benefit so SSA will "reclaim" the amount that covers the days of Feb after her death.
