Is it legal to place a video camera in my mother’s nursing home room?

I would just about bet because of the Hippa Laws it's something not allowed. We are going through some stuff as well with my parents and the nursing home. Good luck to you though.

If it is legal to place one in your home, isn't a room at the NH your home. If so would the guardian be allowed to place one there to monitor their ward?

Hi,
The legality of surveillance is governed by state and local laws. In many places a hidden camera is not legal (especially one that records voices), but a camera that is visible and warning signs posted may be legal. But, again, it is up to local and state laws.
If I were you, I would start with asking the NH administration what their policy is-the staff has no reasonable expectation of privacy at work (in my opinion), so that should not be their objection.

You might want to google: "Are nanny cams legal in nursing homes in ______" and fill in your state.

Who wants to place the camera? If the facility wants to place the camera, they have to have consent from the residents of the room, including roommates. Signs have to be posted that surveillance cameras are in use. If you want to place the camera. I’m not sure what the rules would be. I know homeowners can place “nanny cams”in their own home without notifying the nanny, but I’m not sure you could place a secret camera in her room. If you have suspicions that something is going on, I wonder if it would be admissable.
