My mother passed away 08 and we received a bill from Tenncare for $89,000 in 2010. What can we do do keep the home since we live there now?

My mother passed away 08 and was in and out of the nursing home. She was out when she passed. I have two brothers and two sisters and they have homes and want no part of the estate. We did not receive anything about a probate. What can my wife and I do to keep the home since we live there now?

It sounds like your mother was on Tennessee's version of Medicare, and the state was attempting to recover some of the costs of her care, as they are entitled and mandated to do.

They sent the bill in 2010. What has happened since then? Why is this a particular concern of yours now?

There are some exemptions from the medicare recovery process. For example, were you taking care of her in this home for at least 2 years?

I think that your best bet is to consult a lawyer who specializes in Elder Law.
