Can Mass Health use the CD's my dad and mom put into our names as trustee?

My dad and mom put CD's into each of our names as trustee. Dad passed and the CD read Dad then mom then us. We are running out of funds in their savings and need to get Mass Health started can they say those CD are assets of Moms and we need to use them first? The bank says no but we just wanted to ask others.
