How can the nursing home say they can get me for neglect?

I refuse to take my aging father who wants to go home,he needs 24 care which I can not provide. His doctor saying he needs 24 hour but the nursing home says they can't keep how can they make me come get him when i have no way of providing any care for him.We do not have guardianship over him.
