Do acceptable transfers to disabled child need to be documented and do they need to be in a trust?

I am caring for my mother in my home. Mom has dementia & alzheimers. I am disabled. Caregiver is causing too much pain for me as her illness progresses. Found nursing home, but on waiting list with several. When applying for Medicaid, what documents for transfers are required & do the transfers need to be in a trust? Live in MA.

The first thing you need to do is to find a lawyer specializing in Special Needs Trust.

Medicaid will want her birth certificates, marriage certificates, divorce papers or death certificates, five years of tax returns and financial records, a copy of the deed to the house and any vehicle titles. If you say you are a caregiver, fine. If you say you are disabled, fine. But you can't be both. So decide which exemption you are going for.

Allowed to own under $2, 000 in assets. Expect a 5 yr lookback for her banking.
