Where and how do I start the process of guardianship?

vstefans Aug 2015
You typically need elder law consultation for a guardianship. We did not go with the one a skilled nursing facility suggested but I found one online where the web page showed obvious expertise in the areas we needed. But, if you can share any other details we could talk about other ways to accomplish what you need to do for your loved one.

There are times when alternatives work out fine, but other times when nothing but a guardianship will do, so don't be discouraged by the difficulties if it really has to be done.

If the person is competent to sign documents giving you Durable POA and Healthcare POA, it's more simple to go that route. If they aren't, it's worth a legal consult to get what you will need to prove to the court when you file. They can also tell you if you really need to to get what you need.

Need more info. No POA? Assume person is incompetent? Check with your local senior services organizations. You will need docs report to substantiate condition, maybe attorney to represent you in the process.
