I have an aunt in an elderly home. Her brother is her PoA. He has made it impossible for any of the other siblings to visit.

My Aunt is in an elderly home. Her brother (my uncle) is her PoA but lives in Florida currently and she is in Michigan. He is not aware of her daily interactions with aids and the like. The rest of the brothers and sisters were able to visit her until this week. My Uncle told the elderly home to not allow anybody to see her without his consent. My Aunt is coherent and depressed being in the home and my Father, other Aunts and other Uncle want to remove her from the home. Is there any way to bypass his consent obligation to get her removed from the home? He does not see her nor know what is going with her - does not realize how depressed she is. This is completely unfair to her and my family just wants to make things right by her.

Is this about visiting, or did he block family members from visiting because they want to remove her from the facility?

What happened to bring on this change in visitation?

If she is fairly mentally competent, just have her change her POA. All she has to do is sign a form appointing a new POA and nullifying any previous POA. Standard form that can be obtained online. Nursing home can notarize and witness.

Your only option would be to seek Guardianship in Michigan, by hiring a lawyer and filing a petition in Surrogate's court. The Judge will send a court evaluator to see her, look at her medical history and decide her best placement. The Judge will also address visitation rights as well as conservatorship.
