Can a POA also be a Health-Care Proxy?

Can another sibling be the Health-care Proxy w/o being the POA? I'm am curious to know if my sibling who is Power of Attorney is automatically the Health-Care Proxy or is it easy for the other 3 of us to get one of us as the Health-Care Proxy?

I agree, two very separate docs. My brother is POA, but all three of us sibs have Health Care Proxy.

The POAs for finance and healthcare are assigned independent of each other. My brother is my mother's POA for finance. I am her POA for healthcare.

As far as I know, these are always separate responsibilities, appointed by your mother if she is competent to do so. She can and should choose who she wishes to act in these capacities as long as she is not too far into Alz to not understand what she is doing. In the early stages, this is still possible. If she is not competent, then she has missed the boat as regards a health care proxy. I am not sure what the options are in that circumstance other than applying for guardianship which goes through the courts and is not necessarily awarded to a family member. and is an expensive process. In the absence of a health care proxy, decisions mat be made by the medical professionals in consultation with the family, which could take more time, especially if the family are not in agreement.
