POA is in the name of my mother-in-law. Will there be any problem in it?

My mother is very ill and is 85. I am her only child. Sometimes her mind is clear and sometimes is not. Should I become her Durable Power of Attorney to handle her medical decision and financial matters? Do I need to get a lawyer to do this? What kind lawyer?

You and your husband are moving to Kuwait and you've designated your mother-in-law as Power of Attorney. Is that accurate? Is she moving to Kuwait too? If not, then you might want to find someone who lives closer to you. For example, if you and your husband are in an accident and the hospital needs a POA to act on behalf of you. How helpful is your MIL going to be if she's thousands of miles away?

But having said that, having a long distance POA is better than no POA at all.
