My sister and I want to transfer POA to our other sister who lives out of state. How can we do this?

How do you transfer a POA to another family member if the current POA is not willing to agree and the patient lives in a nursing facility with the onset of dementia?

I should have clarified - As current POA I am able to designate anyone else to act as POA or speak on my Dad's behalf. I actually just need to know if there is a 'formal' form I need to fill out or is a notarized statement with a certified copy of the original POA sufficient. Thanks

Usually one sibling is a POA and the others are secondary or standby POA's. If your sister is not a standby, she would need a temporary guardianship via court order. Have her take dad to an attorney in Texas who can petition the court.

If POA was assigned through an attorney then you need to do a revocation. Once that is done your sister needs to be appointed POA. You'll need to consult an elder law attorney because your dad has dementia and may not be able to make the decision to assign your sister POA. An attorney can advise you.
