How do I obtain legal guardianship of my 90yr. old Dad?

He lives alone in a senior complex (not assisted living) . Each day his ability to care for himself becomes more obvious. In the spring I will probably bring him to live with me. I am his only daughter and oldest child.

we have a dpa and dnr. he is now in danger from one of my brothers. today he brought him a 1990 car, expired insurance, and handed him the car keys. we found out before he drove, but he was thinking about going out to by food (he has plenty). he hasn't driven a car in over a year, and no doubt would be lost. one of the seniors you here about on the news. at this time we cannot legally stop this brother from seeing him as he lets anyone in his apartment.

or .. if he's still lucid, get a Durable Power of Attorney (for health and financial), along with a Medical Directive (or DNR). Avoid the legal battle, if possible.

If his doctor agrees that he is incompetent, you can petition surrogate's court for a full Guardianship which means you protect both the person and the property. You will need an attorney who does family law.
