If mom can prove that the money was spent for her care will she lose community home care?

My mom is receiving communtiy Medicaid in New York and recently her attorney indicated that she was taking too much money from her IRA and that her income level would exclude her from receiving home care. If mom can prove that the money was spent for her care will she lose community home care?
