Can we sell parents home, if one parent is on Medicaid and one needs extra care as well?

Mom is receiving skilled nursing care and will be for the foreseeable future - she was approved for Medicaid. Dad is obese and a fall risk and receives some in home care through the VA - can we sell the home to move him into an FHA rental assisted apartment complex.

If Mom is on Medicaid, you need to talk to an elder lawyer. If Mom is on the deed, half the house is hers. Selling it means half the proceeds are hers. Her half needs to go towards her care. Meaning, Medicaid would stop, she will need to spend down the money, and then apply for Medicaid again.

Is anyone the FPoA or DPoA for your parents? Whose name is on the house title (one or both parents)?

Can it be sold? It depends on who is competent and/or who has the legal authority to do real estate transactions on behalf of your parents.
