When my husband goes to memory care can I sell his car if the title says his name “or” mine?

Do I have to “buy” the car in order to sell it?

The Georgia Department of Driver Services wants to take away my license due to "medical" conditions. Trying to find an attorney who has this specialty. Please help.

What type of medical condition? Physical or cognitive?

You will need to prove to the Dept of Public Safety that you are a competent driver. I suggest you work with your primary care doctor and ask for a virtual driving assessment through the Occupational Therapy dept. This will give you a definitive answer, since it is objective testing for both physical and cognitive.

It's not worth the money to fight it with an attorney -- you will just have to prove you're competent at the end of the day. Be preemptive and give them the test results they will require.

If the title lists both your names with an “or”, then usually either of you can sign to sell it without needing the other’s signature. That means you should be able to sell the car without having to “buy” it from him. If it were an “and”, then both signatures would be required.

That said, since your husband is moving to memory care, it may be wise to double-check with your DMV or local title office so everything is 100% clear for your state. That way you avoid any issues laterr.

Yes. It would only be a problem if it said "and".

Make sure to read the transfer instructions on the back very carefully... in my experience I would not trust the buyer to do the transfer in a timely way, or at all.

Make sure that if you're getting paid in cash you do the transaction with a Bill of Sale and copy all the buyer's license info and address down yourself. One copy for the buyer and one for the seller. This is in case the buyer doesn't transfer the title and starts to rack up tickets with the title still in your name (been there, done that).

Maybe do the transaction at the DMV or court house so there's no excuse to not process the transfer right away.
