YMorton Asked June 2021

If you are married then joint accounts are expected. My husband doesn’t have a retirement plan and minimal social security. Advice?

Because of my retirement annuity he doesn’t qualify for Medicaid. 🤷‍♂️

Yes, you need to talk to a lawyer well versed in Medicaid. The retirement is yours as is your SS. In splitting assets, it may be yours is yours and his is his. You can remain in the home and be given enough to live on. Just giving u the basics. Each state is different as is each situation.

You can check with an elder law attorney or advisor to see about separating out assets in a way to qualify your husband without affecting yourself. As all states have differing requirements it is crucial you check for your own area. Medicaid is a combined program of state and federal. I hope some familiar with this process like Igloo and Stacy will respond to your query here.
