I do private live in care and my employer only gives 6 hours a week personal time and I do 24/7 care. Is only paying me $400 a week legal?

Is this legal?

I know you said it as a rhetorical question, but it's a question that should be asked. If you had known at the beginning the kind of people they are, I doubt you would have anything to do with them. So, do what you would have done in the first place. Get away from them. The longer you stay, the more they will take advantage of you.

Now because I ask for a day off and for them to fix hot water so take a shower they put up a new add and it says pay will be $525 a week more then they are paying me now and offer a day off . Wth what kind of people are they

Go to dol.gov. Read fact sheet #79B. It outlines pay requirements as well as timekeeping and others. There is a phone number on the site to call. They will take questions and give you numbers and access to state resources.

Find a place to move and get out. You can deal with the wage issue once you are not dependent upon them for a place to live.

Be sure and keep that ad that lured you in.

You would be better off at a women's shelter then to continue with your current situation.

i ask for a day off and now they put a add back on Craigslist and change it from the one I started with and put the pay at $525 a week when they can’t even pay me that I only get $400

Talk to the labor board.
room and food is not part of your pay
I would also be concerned if they are paying taxes or if you will be responsible for them come tax time. That will put you in a tough spot!

In response to what you do, it depends on the state you live in. Without knowing that, it is speculation. State laws cannot violate federal law but than can expand on federal law for added protections.

Talk to your local labor board. There are laws regarding in home Caregivers. You get paid at least minimum wage and your room and board can not be figured in that. You work 40 hrs a week any overtime is time and half. You deserve more than 6hrs a week. They are to take SS and tax out of your pay. Matching the SS.

That sounds insane. Are they telling you that your 24 a day service is compensated by living there? Are they at the very least feeding you. I pay my mother's part time aide considerably more than your weekly fee.

Do you have any tangible proof that you have been working for them? A written agreement? Regular checks made out to you from them?

Yes they write a check every Friday to me and it says caregiver in the memo

No, it is not legal. Hypothetically, if an employer makes you sign an agreement that violates law, it makes an agreement invalid. It does not matter if you agreed or not, it violates the FLSA.
