ESLteacher Asked October 2020

How would I find a live-in care position for a student who is looking for a free room? She was previously providing care for a 101 year old.

Bridger, before I even read your post I was thinking "if she is on a student visa wouldn't she have to prove she had a place to stay?"

In some states it is illegal for anyone to receive a free room in lieu of salary for services. Student visas generally do not allow for a student to hold a job for salary. Her expenses should be covered by her sponsor or by her family or country of origin. This should all have been arranged prior to visa being issued.

Thank you for the prompt response. She's here on a student visa, so I wasn't sure if getting a free room in exchange for care was allowed or not.

is she qualified to take care of someone? Are her language skills adequate to live in someone’s house? Personally, I would be leary of bringing a student into my home to care for an elder. There is potential for legal liability issues. Does she have health insurance in the case of illness or accident?

Thank you for the prompt response. I will advise her of the issues.

ESL teacher, is your student a legal resident with ability to get work with FICA? Or are they on a Sponsored path to citizenship program?

I did ESOL volunteer work last millennium & it was pretty strict rules on helping the students find jobs unless they were legally able to work in the country. They could do volunteer stuff and learn job skills & even get certificates or diplomas but couldn’t get “paid”. No “in kind” work either, like free room & board for being a housekeeper. My understanding is its even more strict now and they can’t work at all as the sponsor needs to be providing for expenses & living costs.

If your dealing with anything along these lines, I’d suggest that you find out before you & your students get too involved in all this. It can be a big problem for their getting their needed paperwork.
