Can one be evicted from assisted living during this pandemic? We are waiting on his VA benefits and the office is closed until May 6.

We are awaiting my dad’s VA benefits. All offices are closed. His assisted living said that if he doesn’t get his back pay, they are evicting him. All VA offices are closed. Can they kick him out during this pandemic? They said they can.

I would think that payments are electronic. Are the deposits or paymejts automatic to the facility? I wouldn't think a facility would evict. Most states have a 30 day notice requirement before eviction could occur, with a court order. Most courts are not operating and they certainly would not consider eviction a high priority issue.

Yes, unfortunately, they can. They can evict for non payment. If they said they will kick him out, they likely will. That's the cold reality of for profit AL. I'm not sure what your best next move should be. You may want to talk to the ombudsman, a state social worker (APS) or a lawyer. If you can't safely care for Dad at home, they need to be made aware of that. Let them know that now, very clearly, especially APS.
