Husband on Ohio Medicaid in nursing home. I removed his name from deed to home. What happens if I want to sell?

Can Medicaid recoup any assets from sale?

A judge would need to determine if your husband can be removed from a deed in Oklahoma if he has dementia. All assets must be reported.

Clarock, curious as to why you removed your husband's name from the Deed?

Please make an appointment with an "Elder Law Attorney". When it comes to Medicaid and repaying it can become very complex.

I would think if you sold the house, then your husband would have been entitled to one-half of the equity as the house had been already listed as an Asset. If he has that equity after the house sale, the State may take him off of Medicaid and he would be self-pay until the equity runs out. Again, check with an "Elder Law Attorney".

Don't think his name should be removed. If you sell the house, he is entitled to half the proceeds for his care. When someone is on Medicaid, no assets should be changed.

You really need to ask a lawyer in Ohio. There are a lot of protections in every state for spouses who stay in the community when their husband/wife goes to a nursing home. The rules are very complicated. A good attorney who is well versed in the laws of your state will help you sell the home properly.
