My MIL has living rights as well as my husband and myself. Husband and his mom are both in poor health. Is he eligible for Medicaid?

My husband paid her house off and signed it over so the home goes to our 2 boys. One is disabled. Is the house safe from Medicaid?


What has to be done to make sure the home can’t be taken?


He just met a Spend down for Aug and Sept. Why can’t he have straight Medicaid?


Any suggestions is great.

if your husband paid her house off during the last 5 years, then that’s why he can’t get Medicaid yet. It’s the 5 year look back. Was any of this done with the help of an attorney?

How long ago did your husband and MIL execute the deed change? Is the goal to keep the house as long as MIL, husband or you need it for a home? Or to pass it unencumbered to your sons?

Medicaid like in NH care? Paying off Moms house and signing it over to boys may not have been a good idea in the five year look back. I am assuming that the house was in Moms name and she signed it over. If so this will effect her getting Medicaid. Your husband paying her house off may effect his.
