The HCP has been invoked and I am in the process of becoming her legal guardian. Any advice?

If the guardianship ends when she passes away her funeral expenses can’t be taken care of with her funds? How can I be responsible for that if guardianship ends? Do I pay for all of that prior to her passing?

Hi pamstegma- there is no will nor is there a POA. When my mother passed she didn’t have either as well and not much of an estate so it was easy to become the executor of the estate. I think once I become her guardian I will hire a lawyer for all of this financial stuff to hopefully have things figured out before my GM leaves us.

The Executor of the Will is in charge after the patient dies. It is their responsibility to handle the funeral, the taxes and settling the estate. Read the Will if you can.

If she has funds you can prepay her funeral costs. Medicaid excepts this. If she has a will, the executor should take over.
