If one sibling has POA and the others don't think you are getting your parents into a nursing home fast enough, can they circumvent your POA?

I assume you are healthcare POA as well as financial POA? It is the healthcare POA who determines where the person lives.

Mkbraz, technically you don't "have POA." You're appointed to act on behalf of someone, at their pleasure, and only for their benefit.

Siblings have no input in management, although in an ideal situation they would work with the proxy or attorney-in-fact chosen by your parents.

You do NOT report to them. If they think things should move quicker, make out a checklist, send it to them and ask them to indicate what tasks they'll volunteer to perform.

If the sibs think you are not stepping lively enough, resign POA.

Sibling with POA does the legwork. Not you.

Do YOU have POA?  Are parents on waiting lists for NHs you are interested in?

All of this can change in a second. If parent falls, has medical issue and need a to go to hospital,  then you need to know where you want them to be admitted.

What information are you needing to gather?

We decided it will be best for them a couple of months ago. However, they have to go as private care with Medicaid pending. It is taking time to gather and confirm their info. Validity of ins., veterans benefits , etc. so, it's a timing issue. They are no better or worse than they've been for the last year. They do not contribute much to helping with their care and I take care of all medications, and general care. I work full time and I have take off to be able to make phone calls and the running around. Can't make them understand that no one talks to u or releases info w/o proof of POA. They are now pressuring/demanding to know where I am with it. Told them I would get with them when I had all info gathered. Not good enough...

Your siblings seeking guardianship will only work if your parents are incompetent according to a doctor.

Why do they think you are moving too slow?

BarbBrooklyn Sep 2017
If the parent is competent, they can assign poa to someone else.

The sibling can seek guardianship, which overrides poa.

Who isn't moving fast enough, and why?
