My aunt set up a trust for my mom, but she passed away and now my aunt wants to split up the money between my siblings and I. Can she give us this money?
I'm my aunt's POA and she is in her own place with home health care. She had a 30 year in trust for my mom who passed away almost a year ago. If she needs a nursing home in the future she has the money to pay for about 3 and a half to 4 years.
I think there is a 5 year look back. That means if she needs care and can't afford it, Medicaid will look back 5 years to see if she gave money or property away.
