He would have to hire an attorney and petition the court for Guardianship.

Oilmanswife, we really do need much more information to help you with our answers. Like, why does your Mom's brother want to take care of her? Does he suggest that she be placed in Assisted Living/Memory Care?

I am her POA no my mother has dementia and does not know what is going on around her

Can you give more details of the situation. Like, is there an appointed POA? Is there a court appointed Guardian? Is your mother competent?
