My sister (62) has no money is in very poor health. Any advice?

Has lung cancer and periphrial vascular disease. She has had her left leg below the knee removed. in the past month she has had three strokes. Her s.s. was taken away from her as well as her medical. she had to stop her cancer treatments because of no insurance. she is fighting to get it all back.

She must be on Medicaid rather then Medicare. If she received $15,000 from a lawsuit I do not think Medicare would penalize her, but Medicaid would. To be eligible for Medicaid her assets have to be down to $2,000. If she receives any monies from any source she is required to report it. Medicaid will penalize her until that $15,000.00 is down to $2,000.00. She is prohibited from gifting any part of the $15,000.00 to anybody or she will again be penalized. The money can be spent for her needs and she should keep very close track of how the money is spent.

everything was taken away from her because they said that because she didn't report to S.S. that she received $15,000.00 from a lawsuit. Her attorney told her to deposit it and she would have no problem with S.S, This was because of the leg that was made for her was not properly made and caused her big problems. S.S. claims she committed fraud. Her attorney has had several meetings with S.S. trying to get her benefits back. In the mean time he has been paying for her meds which come to about $500.00 per month. I am 70 on a fixed income and my wife I contribute what we can but it is very hard. Her attorney keeps telling that she will get it back, in the mean time she isn't getting any medical treatments. I just don't know what to do.

Cant she get on Medicaid? I would think that would be better for her anyway.

I sounds like she would qualify for expeditied Medicare. Ask the 800 # what documentation they need for her medical status. Ask the social worker for assistance.
