If my mom has deeded me her house can Medicaid still take it if she needs to go on full Medicaid?

I need to get in-home help for her while I work.

When did this transfer of property occur? Did Mom simply give you the house, or did you pay for it?

If you paid for the house, or if it was transferred more than 5 years before needing to apply, then, no, the state's Medicaid recovery program will not expect to be paid back from your house.

The more immediate issue is the one Rainmom and Pam mention -- having given away assets (if that is what Mom did) will have a big impact on her eligibility for Medicaid in the first place.

I suggest you contact an Elder Law attorney now and learn how you can best position Mom for her current and future needs. That specialty is critical -- this is not the time to talk to your cousin the tax lawyer or your aunt who practices family law. You need a specialist who understands how to navigate the Medicaid rules.

Now that she deeded the house, you can forget about getting Medicaid for five years. Medicaid does not allow gifting.

Either that or she will be denied Medicaid - if the transaction took place within the last five years.
