If a person is DPOA but never checks on the person and complains about getting them care. Can we take her off?

She didn't have dementia when my cousin was made dpoa. She broke her hip and was put into a rehab facility for six weeks. That's why they did this in the first place. Since then she has been diagnosed with dementia but the treatment of her stays the same. My cousin tells her she can't buy certain things because she doesn't have money. Before my cousin took over my grandma had well over 15,000 in the bank now she's broke.

Your aunts can't choose a proxy for your grandmother unless they already were proxies themselves and your grandmother had dementia to the extent that she was unable to make legal decisions.

Thank you. Unfortunately grandma does have dementia and my cousin will not resign because it will benefit my mother and to her being dpoa is all about control. My cousin was chosen by my other aunts not my mother who has taken care of her for 9 yrs.

The only person that can change grandma's DPOA is grandma. If grandma is competent she can revoke old DPOA and assign new one. If she has dementia grandma will not be able to change DPOA if not competent. Cousin can resign and grandma assign one also. If it's so much trouble cousin might agree.
