My husband has dementia, how does that affect my rights if he has a living child from another marriage?

You need to make an appointment with an attorney specializing in elder law. The fact that he has a child from another marriage may effect your inheritance rights and position if your husband doesn't have a will. It will not effect how marital assets will be claimed by Medicaid should your husband need institutional care and run through his assets.
