As POA for my Mom, am I permitted to take anything out of a safe deposit box that she shares with a friend?

My mother has had a massive stroke and I am her POA. She is in a nursing home and we are moving her out of her apartment. We are incurring extra expenses such as a storage unit, towing and repairs for her car, etc.

aplakrit, would the friend who shares the safe deposit box be able to come with you to point out what belongs to him/her? You wouldn't want the friend to say after the fact that this or that was missing.

My guess is the bank may let you acess the box with your POA. You may have to get the friend to agree to let you have acess. Or your mother can sign paperwork to allow you acess if she's able. I had a similar expience with my dad as his dementia was progressing. I was able to convince him to let me sign up at the bank for acess to his box. He was putting things in and taking them out constantly. I got to it just in time and rescued deeds, titles and original copies of up dated wills . I made copies, put them in the box and kept all the original stuff.

Any thing you take out of there must be reported to Medicaid.
