1 of my brother's has Mom's policy in which he has removed me. Advice?

I'm taking care of my Mom (past 12 years),she does not like to stay with other kids. Of it,now he has removed without my concern and refuse to add me ,while he doesn't do nothing for my mother?please advise me what to do?

surenkim, cmagnum is correct. The owner of the policy decides who the beneficiary is. You have no legal say in the matter. Sorry.

He owns the policy and thus can change the beneficiary as he wants to. That would not be true if your mother owned the policy.

Sounds like there is a lot of bad blood between you and your brother.

My brother has the policy ,he is the owner,i was added since the policy was taken, after business dispute,he removed me from the policy,i owe him nothing and policy has nothing to do with policy.Should hire attorney, and go thru court...

Does he own the policy or does your mother own the policy? What has he done? Did he remove you as a beneficiary of the policy?

yes life policy???

JessieBelle Jan 2015
Do you mean he has a life insurance policy on her? I'm not sure what the question is. Who owns the policy? Only the owner of a policy can change the beneficiaries. If he is the owner of the policy, then I assume that he paid for it and can name the beneficiaries he chooses. Please explain more and someone may have better information for you.

What policy are you talking about?

Are you speaking of durable and medical POA?

He can't add you to the POA. Only your mother, if she is still competent, can do that.

If she is still competent, she can have new POAs written up, signed and notarized that would make you her POA.

With him doing nothing for mom and you doing all of the caregiving, it would make more sense for you to be the POA.
